Çağdaş dönem fıkhi düşüncenin tecdidi bağlamında makasıdü’ş-şeria çağrısı islam hukuku araştırmalarında önemli bir yer tutmuştur. Araştırmacılar makasıdü’ş-şeria konusunu farklı yönleriyle ele almışlar, önemi, etkisi ve fakih ile müçtehidin ona ihtiyacı üzerinde vurgulu bir şekilde durmuşlardır. Makasıdü’ş-şeria şeriatın orta bir yol üzere devam etmesinin bir vesilesi ve kemal ile cemal noktasıdır. Fakih şeri ameli hükümleri istinbatta, müçtehit içtihadında, müfti müsteftiye en uygun fetvayı vermesinde ondan yararlanır, Makasıd aynı zamanda müftinin fetvasını kontrol imkanı verir, tearuz halinde en uygun tercihe ulaşmasını sağlar, ibadet ve kullukta şarinin maksatlarını tatbik imkanı verir.
Müftinin fetva verirken temel görevi, şarinin hitabını yeni çıkan meselelere uygulamak, makasıdü’ş-şeriayı her bir müsteftinin meselesine tatbik etmektir. Bu aynı zamanda fetva vermenin temel hedefidir. Önceki müftilerin fetvaları gözden geçirildiğinde fetvanın verilmesinde makasıdü’ş-şerianın önemli bir yer tuttuğu görülür. Bu müftilerin fetvalarında makasıdü’ş-şeriaya itina gösterdiği, içtihat ve fetvalarında uyguladıkları görülür ki bizi bu konuyu araştırmaya iten de budur.
In the context of the renewal of contemporary canon law, the call for Maqasid al-Shariah has taken center stage in Islamic law studies. Researchers have approached the issue of Maqasid al-Shariah from various angles, emphasizing its importance, influence, and necessity by jurists and mujtahid. Maqasid al-Shariah is a mean to achieve the moderation, perfection and beauty of Sharia, which the jurist uses in researching the scientific legal rulings, the mujtahid in his ijtihad, and the mufti in reaching the closest and most correct rulings in the fatwas for fatwa askers. Maqasid al-Shariah also enables to control the mufti's fatwa, allows him to reach the most suitable choice in case of disagreement, and to apply the aims of sharia in worshipment and servitude. The main task of the mufti while giving a fatwa is to apply the commentator's address and the maqasid al-shariah to the newly emerging issues and the issue of each mufti. When we look to ijtihad or fatwas of the previous muftis, the Maqasid al-shariah is apparently being consideration principles the muftis pay attention to and apply, which is what prompted us to investigate this issue.
